Acknowledgment of fire risk

The Client acknowledges and agrees that:

  • in the event of a bushfire, the level of risk of damage to people and property is significant and dependent on immeasurable variables, and as such, even the implementation of best practice mitigation strategies cannot eliminate the risk of harm;

  • the Inspection and Written Report is intended to help Clients reduce the risk of damage to people or property, but it cannot remove the inherent risks in the event of a bushfire;

  • even if the Client implements all recommendations from the Inspection and Written Report, there is no guarantee that there will be no loss or damage suffered by the Client (or any other party); and

  • ultimately it is the responsibility of the Client to determine and act on their own bushfire action plan with reference to the Client’s own individual circumstances.

 

To the maximum extent permitted by law, Firewise Assist is not liable to the Client (or in any way responsible) for:

  • any loss or damage suffered by the Client (or any other party) in the event of a fire, even if the Client implements all recommendations from the Inspection and Written Report;

  • any loss or damage suffered by the Client (or any other party) in the event of a fire which relates to any decision made by the Client which is informed by any recommendations from the Inspection and Written Report;

  • any loss or damage suffered by the Client (or any other party) at the Site in the course of Firewise Assist carrying out the Services; and

  • any other risk specifically excepted elsewhere in these Terms.
